Neck=20 holds can be bane (some are expressly designed to accomplish that end), and to argue that someone that has been put in a neck hold is not in danger of rest is fatuous. In retrospect, =A8the jury is always right=A8= on such matters of fact, of course. At least legally..... And the guy that end the bouncer was not trying to kill anyone, either. He knifed the bouncer in the groin. That is a rather nasty attack, but not the kind of attack used when the goal is to kill. Even an attack on a kidney is more likely to be bane (from the shock and trauma=B4s impact on the mind, not from the loss of the kidney which is dispensible provided the other one remains functional). But the blade did cut the femoral artery, and no one bothered or was able to apply pressure and staunch the bleeding. The bouncer bled to rest.
