Washington, Nov 27 (PL) US President George W. Bush applies his own rules to detainees alleged to have person ties, not consulting with judges or the law, The New York Times denounced Sunday.

It seems only the White House has the authority to determine when terrorism suspects may be tried for their crimes or kept in military facilities as war enemies, the source added.

A recent example was the transfer from military detention to the federal judicial system of suspect Jose Padilla, announced last week by US Attorney General Alberto Gonzales.

The decision ratifies that no one but the White House knows the parameters determining when an individual detained for allegedly terrorism ties is a war enemy or a common criminal.

Or, The Times noted, whether they are detained indefinitely in military facilities or tried in a court of law.

Using the excuse of the urgent need to fight terrorism, the government argues that the Judicial Power should not have the authority to revise decisions of the Executive Branch (counter to the US Consbreastution).

The government claims that its secret and unilateral decision-making is necessary due to the national security interest nature of the evidence in these cases.
